The terms.

1. Who we are, and what you are agreeing to

Archivald is operated by Insight Personal Finance, LLC (“Archivald”, “we”, “us”). By creating an account or using archivald.com you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 to hold an account. If you are using Archivald for a business, a studio, an estate or a household, you confirm you are allowed to bind it to these terms.

2. The service

Archivald lets you record pieces you own, made or hold on consignment — photographs, details, costs, valuations, locations, sales, exhibitions, contacts — and generate documents from those records: catalogues, reports, invoices, consignment agreements, shipping documents and the like. Features vary by plan and may be added, changed or withdrawn; we will not remove your ability to read and export what you have recorded.

3. Your records are yours

Everything you enter or upload — photographs, documents, prices, notes, contact details — stays yours. We claim no ownership of it. You give us only the permission we need to store it, display it to you and the people you share it with, and turn it into the documents you ask for.

You are responsible for what you upload: that you are entitled to store the photographs and documents, that the contact details you keep are ones you may keep, and that what you record is accurate to the best of your knowledge. Archivald never invents a figure. A blank is a blank; a sum leaves out anything without a price and says so.

4. Records, not advice

Archivald is record-keeping software. Nothing in it is legal, tax, financial, insurance or appraisal advice, and we are not a licensed adviser, appraiser or law firm.

• Valuations and performance figures are the figures you entered, arranged. A cost-basis, a gain, an annualised return or an insurance total is arithmetic on your own records, not an opinion of value.
• Generated documents — estate or insurance reports, personal property memoranda, invoices, consignment agreements — are templates filled from your records. Whether a document is sufficient, enforceable or correctly worded for your situation and your jurisdiction is for you and, where it matters, your attorney, accountant or insurer to decide.
• Settle. A household list made with Settle is a shared record of what there is and what each person would like. It is not a separation agreement, a settlement, a valuation or a court document, and nothing marked in it binds anyone. Take it to your mediator or attorney; do not rely on it in their place.

5. Sharing and access

You decide who sees your records. You may invite people into your account as members, share a single collection, or invite a second person into a Settle list. Anyone you invite sees what the invitation grants them, and you are responsible for whom you choose. Remove access when it should end; we act on what your account says.

Keep your sign-in to yourself. Archivald signs you in by a link sent to your email (or through Google, if you choose); whoever controls that inbox controls the account.

6. Plans and payment

Archivald has a free plan and paid plans. What each includes, and what it costs, is published on the site. We will tell you by email before we begin charging for anything, and a price you start on is the price you keep for as long as you stay on it, as the site describes. When payments begin they will be handled by a payment processor; we will not hold your card details ourselves.

If you stop paying, your records remain readable and exportable; the features of the paid plan switch off until you resume.

7. What you may not do

• Use Archivald to store material you have no right to store.
• Use it to harass, defraud or misrepresent anyone — including by producing a document that claims a value, a sale or an agreement that did not happen.
• Probe, overload or interfere with the service, or access another person’s records without their invitation.
• Resell the service or represent it as your own.

We may suspend or close an account that breaks these rules. Where we can, we will tell you first and give you a chance to export your records.

8. Availability, backups and leaving

We work to keep Archivald available and your records intact, and we keep backups so that a failure on our side does not lose your work. We cannot promise uninterrupted service. Keep your own copies of the documents that matter — every document Archivald produces is a file you can download.

You may close your account at any time by writing to hello@archivald.com. We will delete your records as described in the Privacy Policy. If we ever wind the service down, we will give you at least 60 days’ notice and the means to take your records with you.

9. Our liability

Archivald is provided as it is. To the fullest extent the law allows, we are not liable for indirect or consequential losses, for decisions you make on the basis of your own records or the documents generated from them, or for the acts of people you have given access to. Our total liability to you for anything arising from the service is limited to the amount you paid us in the twelve months before the claim, or US $100 if you paid nothing. Nothing here limits liability that the law does not allow to be limited.

10. Changes to these terms

If we change these terms in a way that matters, we will email the address on your account before the change takes effect. Continuing to use Archivald after that date is acceptance of the new terms.

11. Law

These terms are governed by the laws of California, United States, and any dispute will be heard in its courts.
